OVERVIEW

Welcome to Outlier Laser Engraving, a business operated by The Delightful Dabbler LLC, doing business as Outlier Laser Engraving ("Outlier Laser Engraving," "we," "us," or "our").

These Terms of Service ("Terms") govern your access to and use of our website, online store, products, and services (collectively, the "Services"). Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and services.

By visiting, browsing, purchasing from, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not access or use our Services.

SECTION 1 – ELIGIBILITY AND ACCOUNT

By using our Services, you represent that you are at least the age of majority in your state or province of residence or have obtained permission from a parent or legal guardian.

If you create an account, you agree to provide accurate and complete information and to maintain the security of your login credentials. You are responsible for all activity occurring under your account.

SECTION 2 – PRODUCTS

We strive to display our products as accurately as possible. However, due to differences in monitors, mobile devices, lighting, and photography, colors and appearances may vary slightly.

Many of our products are handcrafted and engraved using natural materials. Variations in wood grain, knots, texture, slate, leather, acrylic, metal finishes, engraving depth, color, and other natural characteristics are expected and make each piece unique. These natural variations are not considered defects.

We reserve the right to discontinue or modify any product without notice.

SECTION 3 – CUSTOM ORDERS

Many of our products are personalized or custom-made.

Because custom products are created specifically for each customer:

  • Orders cannot be canceled once production has begun.
  • Changes cannot be guaranteed after production starts.
  • Customers are responsible for verifying all names, dates, spelling, artwork, measurements, and personalization details before submitting or approving an order.
  • We are not responsible for customer-approved errors.

Orders are accepted only after payment has been successfully processed.

We reserve the right to refuse or cancel any order at our discretion.

SECTION 4 – DIGITAL PROOFS

When a digital proof is provided, it is the customer's responsibility to review every aspect of the design before approval.

Approval confirms that you accept:

  • spelling
  • grammar
  • dates
  • layout
  • sizing
  • artwork placement
  • personalization
  • design

Once a proof has been approved, Outlier Laser Engraving is not responsible for errors contained within that approved proof.

SECTION 5 – CUSTOMER ARTWORK

Customers may upload logos, artwork, photographs, trademarks, or other materials.

By submitting any artwork, you represent and warrant that:

  • you own the material or have permission to use it;
  • the material does not infringe any copyright, trademark, or other intellectual property rights;
  • the material complies with applicable laws.

You grant The Delightful Dabbler LLC d/b/a Outlier Laser Engraving permission to reproduce your submitted artwork solely for the purpose of fulfilling your order.

You agree to defend, indemnify, and hold harmless The Delightful Dabbler LLC from any claims arising from artwork you provide.

We reserve the right to refuse any design we believe may violate intellectual property rights or applicable law.

SECTION 6 – REFUSED ORDERS

We reserve the right to decline any order containing material that we determine to be:

  • unlawful
  • defamatory
  • threatening
  • hateful
  • discriminatory
  • obscene
  • sexually explicit
  • harassing
  • infringing upon intellectual property rights
  • otherwise inappropriate or inconsistent with our business values.

SECTION 7 – PRICING

Prices are subject to change without notice.

Posted prices do not include:

  • shipping
  • taxes
  • customs fees
  • import duties

Pricing errors may be corrected at any time.

SECTION 8 – PAYMENT

Payment is required before production begins.

You represent that all payment information submitted is accurate and that you are authorized to use the payment method provided.

SECTION 9 – SHIPPING

Shipping estimates are estimates only.

We are not responsible for delays caused by:

  • USPS
  • UPS
  • FedEx
  • weather
  • customs
  • carrier delays
  • events beyond our control

Risk of loss transfers to the customer when the order is delivered to the shipping carrier.

SECTION 10 – LOCAL DELIVERY OR PICKUP

For local orders, customers are responsible for arranging pickup or accepting agreed-upon local delivery.

Ownership transfers upon delivery or pickup.

SECTION 11 – RETURNS & REFUNDS

Because nearly all of our products are personalized or custom-made:

ALL SALES ARE FINAL.

Returns, exchanges, or refunds are not accepted due to:

  • buyer's remorse
  • incorrect information supplied by the customer
  • customer-approved proof errors
  • natural material variations
  • color differences caused by monitors

If your item arrives damaged or contains a manufacturing defect, you must notify us within 7 calendar days of delivery.

Please include photographs showing the issue.

Upon review, we may, at our sole discretion:

  • repair the item;
  • replace the item; or
  • provide another reasonable resolution.

Claims submitted after seven (7) days may be denied.

SECTION 12 – INTELLECTUAL PROPERTY

All website content including:

  • logos
  • photographs
  • graphics
  • product descriptions
  • designs
  • text
  • videos
  • branding

is owned by The Delightful Dabbler LLC d/b/a Outlier Laser Engraving or its licensors and is protected under United States intellectual property laws.

No content may be copied, reproduced, distributed, or used without written permission.

SECTION 13 – PRODUCT PHOTOGRAPHY

Unless otherwise agreed in writing before production begins, we reserve the right to photograph completed products for use in:

  • our website
  • social media
  • online portfolio
  • advertising
  • promotional materials

Customers requesting confidentiality should notify us before production begins.

SECTION 14 – OPTIONAL THIRD-PARTY TOOLS

Our website may include tools or services provided by third parties.

These tools are provided "as is" without warranties.

We are not responsible for third-party services.

SECTION 15 – THIRD-PARTY LINKS

Our website may contain links to third-party websites.

We are not responsible for their content, products, privacy practices, or policies.

SECTION 16 – SHOPIFY

Our online store is powered by Shopify.

Purchases are made directly with The Delightful Dabbler LLC d/b/a Outlier Laser Engraving and not with Shopify.

Shopify bears no responsibility for transactions between you and our business.

SECTION 17 – PRIVACY

Personal information is governed by our Privacy Policy and Shopify's Privacy Policy.

By using our Services, you consent to the collection and processing of your information.

SECTION 18 – FEEDBACK

Suggestions, reviews, comments, and feedback may be used by us without compensation.

You represent that any feedback submitted belongs to you and does not infringe the rights of others.

SECTION 19 – PROHIBITED USES

You may not use our Services to:

  • violate laws
  • infringe intellectual property
  • harass others
  • upload malware
  • interfere with website security
  • scrape website content
  • impersonate others
  • misuse automated systems
  • conduct fraudulent activity

Violation of these Terms may result in termination of access.

SECTION 20 – DISCLAIMER OF WARRANTIES

All products and services are provided "AS IS" and "AS AVAILABLE."

To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

SECTION 21 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, The Delightful Dabbler LLC d/b/a Outlier Laser Engraving shall not be liable for indirect, incidental, consequential, punitive, or special damages arising from the use of our Services or products.

Our total liability shall not exceed the amount paid for the specific order giving rise to the claim.

SECTION 22 – INDEMNIFICATION

You agree to indemnify and hold harmless The Delightful Dabbler LLC, its owners, employees, contractors, and affiliates from claims arising out of:

  • your breach of these Terms;
  • your submitted artwork;
  • misuse of our products;
  • your violation of any law or third-party rights.

SECTION 23 – GOVERNING LAW

These Terms shall be governed by the laws of the State of Connecticut, without regard to conflict-of-law principles.

Any legal proceeding arising from these Terms shall be brought exclusively in the state or federal courts located within Connecticut.

SECTION 24 – SEVERABILITY

If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

SECTION 25 – ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Refund Policy, constitute the complete agreement between you and The Delightful Dabbler LLC d/b/a Outlier Laser Engraving regarding the use of our Services.

SECTION 26 – CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time.

Updated Terms become effective immediately upon posting unless otherwise required by law.

Continued use of the Services constitutes acceptance of the revised Terms.
